This second-appeal came up for hearing on 17.07.2008 pursuant to
Commission’s hearing notice dated 19.06.2008. Appellant was present through
his Counsel, Shri Vikas Yadav. Respondents were represented by
Shri R.M.Saxena, Assistant Commissioner of Central Excise.
2. At the outset, the Counsel for the appellant mentioned that his client
wished to restrict his request for information to item no.8 of his RTI-application
dated 01.10.2007. This item of query read as follows:-
“(8) Please supply the copy of roster (both vacancy and post based)
maintained for promotion of Inspector to Superintendent as well as
direct recruitment of inspector cadre since 1997.”
3. Respondents stated that they had no objection to provide this information
to the appellant provided he paid the cost, which had, according to the
respondents, already been intimated to the appellant through CPIO’s
communication dated 12.02.2008.
4. In view of the fact that the respondents are willing to provide this
information, it is directed that on receiving the requisite payment from the
appellant, information may be transmitted to him within one week of the receipt
of this payment, which should be made not later than two weeks of this order.
5. Appeal is disposed of with these directions.
6. Copy of this decision be sent to the parties.
