Facts
In his letter of 18.8.2008, the appellant had alleged that IT PAN No.
AIO02788G was issued in the name of Shri Ankit Dhir S/o Shri Pankaj Dhir
on the basis of forged document submitted by him. The appellant had raised
certain queries on this issue and requested for ATR in regard to the
cancellation of the above mentioned PAN number etc.
2. It appears that the officers of the Department quibbled over
jurisdictional matters and no inquiry was caused as to whether the PAN under
reference was, indeed, issued on the basis of forged documents.
3. The present appeal has been filed by the appellant as he received no
response from the CPIO concerned. At the very thrashold, it may be observed
that it has been wrongly registered as an appeal; it should have been registered
as complaint.
4. Be it as it may, the matter was heard on 13.2.2009. The appellant did
not appear before the Commission. The Income Tax Department is
represented by officers named above. It is the say of Shri Jha that a bit of
confusion took place as the appellant herein filed a number of complaints and
the jurisdictional issue has now been settled. He assures the Commission that
an inquiry would be caused into the matter and appropriate consequential
action taken and thereafter a response sent to the appellant.
DECISION
5 In view of the above, Shri Upender Kishore, ITO, Ward-24 (I) (CPIO),
New Delhi, is hereby directed to cause an inquiry into the matter and take
consequential action as per law within 06 weeks time and thereafter send
requisite information to the appellant.
6. The matter stands closed at the Commission’s end.
