Background

1. The Applicant filed an RTI application dt.7.2.09 with the CPIO, BSNL, New
Delhi. He stated that the BSNL Corporate office vide letter dt.22.8.06 stated
that at present the December 2002 exam documents are with CBI and after
receipt of the exam documents from CBI, the seniority will be fixed of Shri
Manish Kumar Jain and as per BSNL Corporate Office letter dt.17.12.07, it has
been mentioned that seniority of Shri Manish Kumar Jain has been fixed. In
this context, he requested for the following information:

i) What is the current status of the documents from CBI. Received or
not. If received the receiving date from CBI.

ii) Why seniority has not been fixed i.r.o applicant. If done, the current
status

iii) The All India Seniority no. of the applicant and name and seniority no.
of the office just above and below the applicant along with seniority list no.

iv) The All India seniority year for which seniority has been given to the
applicant.

On not receiving any reply, the applicant filed a complaint dt.13.4.09 before
CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 28, 2009.

3. Mr.Suresh Kumar, CPIO and Mr.Joginder Singh, AGM represented the Public
Authority.

4. The Applicant was not present during the hearing.
Decision

5. The Respondent submitted that after the results were declared with regard to
TES Gr.B Departmental Competitive Exam held on 1.12.2002, the entire file
was seized by the CBI who was asked to investigate into the matter. He
stated that the Applicant has been placed after S.No.105 against the
vacancies for the year 1997-98. He also produced a copy of the letter written
by the Applicant stating that he has received the information.

6. Since the available information has been provided, the appeal is accordingly
disposed off.
