                     Appeal No.CIC/WB/A/2008/00697-SM dated 16.10.2007
Right to Information Act-2005-Under Section (19)

                                                                                      Dated 24.03.2009

Appellant : Shri Hareshwar Janardan Bhoir

Respondent : Mazagon Dock Limited, Ministry of Defence

The Appellant is present.

On behalf of the Respondent, Shri M. Selvaraj, CPIO, is present.

The brief facts of the case are as under.

2. The Appellant had requested the CPIO, in his application dated 16 October 2007 for a
number of information regarding the money deposited by the Appellant as a member of a
Cooperative Housing Society. The CPIO, in his reply dated 12 November 2007, provided him with
point wise reply/information. He was not happy with the reply and appealed to the first Appellate
Authority on 10 December 2007. That Authority decided the appeal in his order dated 28
December 2007 and endorsed the information already provided by the CPIO earlier. The
Appellant has come before us in second appeal against the above order.

3. The hearing was conducted through videoconferencing. We carefully considered the
contents of the appeal and the documents enclosed therewith. Comparing the information sought
and what has been provided to the Appellant. We find that the CPIO has indeed given all the
information that the Public Authority held on the subject. The Appellant specifically submitted that
he wanted the MDL to give him a receipt for the money he had deposited in the past as a
member of the said Cooperative Housing Society. Though the Respondent claimed that the said
money had been deposited in a specific account in the Canara Bank and not with the MDL, we,
nevertheless, direct the CPIO to inform the Appellant within 10 working days from the receipt of
this order on whether the MDL had ever issued any receipt for any such amount that the
Appellant might have deposited. If indeed, the MDL had issued any such receipt, the CPIO
should provide a copy of the counterfoil of that receipt, if still available in their records. However, if
no such receipt had ever been issued, he must say so in his reply.

4. With the above direction, we dispose off this appeal.

CIC/WB/A/2008/00697-SM

5. Copies of this order be given free of cost to the parties.
