FACTS
:
By his letter of 28.06.2008, the appellant had sought information
about a plot of land bearing No. A-81, C.R. Park, New Delhi allotted to
Bipin Chandra Paul Memorial Trust some time back. The queries raised by
the appellant were: when the plot of land was allotted; terms & conditions
of allotment; whether the land so allotted could be utilised for commercial
purposes etc.
2. Smt. Usha Ravichandran, Dy. Director (IL), (CPIO), had responded
vide letter dated 04.08.2008 stating that in absence of the File No. having
been given by the Appellant, information sought could not be provided.
Shri Devesh Singh, Director (Land), (AA) vide letter dated 23.12.2008 had
upheld the decision to the CPIO and dismissed the appeal.
3. The present appeal is directed against the order of CPIO/AA.
4. Heard on 04.09.2009. Appellant present. Neither CPIO nor
Appellate Authority is present. This is viewed adversely. It is the
submission of the appellant that DDA allotted a plot of considerable size to
the above mentioned Trust and it is inconceivable that DDA officials can
not trace out the File No. We totally agree with the submission of the
appellant and deprecate the stand taken by CPIO and AA.
DECISION
5. In view of the above, Smt. Usha Ravichandran, Dy. Director (IL), is
hereby directed to trace out the file and provide requisite information to the
appellant in 06 weeks time.
6. If the appellant does not get this information 06 weeks time, he will
be at liberty to move the Commission again.
7. We also record our displeasure for non appearance of a responsible
DDA official before us on the date of hearing and hope that this would not
recur.
