Background
1. The Applicant filed an RTI application dt.20.3.09 with the CPIO, DoP, Etawah
requesting for information on action taken on his letter dt.3.3.09. He also requested
for the rule by which he is being paid the salary of GDS even after becoming postman
on 25.10.09. On not receiving any reply, he filed a complaint dt.6.6.09 before CIC.
The Commission vide its order dt.30.9.09 directed the CPIO to provide the
information to the Applicant by 30.10.09 and also to respond to the showcause notice
issued to him by the Commission for the delay in supply of information, by 5.11.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for November 19, 2009.
3. Shri Sujeet Kumar, SDI representing CPIO represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondents submitted that the Complainant was initially informed on 13.4.09
that the enquiry is under progress and another reply was provided on 11.5.09 and
once again on 23.6.09, when the enquiry report was also provided.
6. The Commission holds that there is no delay on the part of the Public Authority in
furnishing information and drops the penalty proceedings against he CPIO. It was
observed that the complaint was filed before the receipt of the enquiry report. Since
the Complainant has not responded after receiving the information, it seems that he
is satisfied with the information provided and accordingly the complaint is disposed
off.
