Background
1. The Applicant filed an RTI application dt.9.4.09 with the CPIO, DoP, Barmer.
He requested for information regarding i) denomination of postal orders; ii)
whether the RD agents and families can sit in the office and make entries in
the diaries; iii) whether the RD agent is given more importance than to a
common man etc. The CPIO replied on 16.4.09 furnishing point wise
information . Not satisfied with the reply, the Applicant filed an appeal
dt.20.4.09 with the Appellate Authority stating that information has not been
received against points (ii) to (v). The first Appellate Authority replied on
21.5.09 upholding the decision of the CPIO and informing the Appellant once
again that points (ii) to (v) do not fall under the definition of information as
given under section 2(f) of the RTI Act. Aggrieved with the reply, the
Applicant filed a second appeal dt.23.5.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 18, 2009.
3. Mr. Vijay Kumar Khatri, Inspector of Post Offices, Barmer represented the
Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that despite the fact that the Appellant had not
paid the RTI fees both the CPIO and the Appellate Authority had provided
available information with regard to Point (i). The Commission upholds the
decision of both the CPIO and the Appellate Authorities with regard to points
(ii) to (v) and holds that no information as defined under Section 2(f) of the
RTI Act has been being sought by the Appellant against these points and
accordingly rejects the appeal.
