FACTS

 

  By his letter of 7.1.2008 the appellant had sought information on the following
two points from the CPIO :-

i. “Cross examination in police enquiry Inspector, Amarjit Singh of CBI, on
29.10.2000 the signed copy of Amarjit Singh withdrawal shown of Rs. 30,000/-
of the a/c of Hazari Lal.

ii. On 14-15-16/10/2000, the Aslah was received by Rajesh Kumar from
Malkhana PS Mani Majra at what time and at what time returned back to
Malkhana. Rajesh Kumar CHG No. 802.”

2. The CPIO vide his letter dated 17.1.2008 had given the following information
to the appellant;

i. “Your attention is drawn towards this office Memo No. 538/RTI-

07/CPIO(PHQ)/UT/22698 dated 6.8.2007 and No.26693 dated 18.9.2007.
ii. Your application is transferred to DSP-cum-CPIO (East) under section 6(3) of
RTI Act for its disposal on this point at his level.”

3. Dissatisfied with this, the appellant had filed first appeal on 19.2.2008 before
the Appellate Authority. From the perusal of the Commission’s file, it appears that
the appeal has not been decided by the Appellate Authority.

DECISION

4. Sr. Superintendent of Police & Appellate Authority is hereby directed to
intimate the Commission whether the appeal has been decided and, if yes, furnish a
copy of the order passed by him to this Commission in one week time.

5. However, if the appeal has not yet been decided, the AA is directed to do so in
three weeks time and also to explain the reasons for the inordinate delay in deciding
the appeal.

6. Copies of RTI request dated 10.12.2007, CPIO’s reply dated 8.1.2008 and the
first appeal filed by the appellant are enclosed for ready reference.

7. The matter is disposed of as directed herein above.
