Background:
Shri Jitender Kumar Sharma of Ajmer filed an RTI-application with the
Public Information Officer, North Western Railway, Jaipur, on 18 September
2007, seeking information relating to his service matters.
2. The PIO vide his letter dated 5 October 2007 replied to the RTI-
application. Not satisfied with the reply of the PIO, the Appellant filed an
appeal with the first Appellate Authority on 13 November 2007 who vide his
letter dated 17 January 2008 replied to it. Thereafter, the Appellant
approached the Central Information Commission with a Second Appeal on 14
April 2008 which was registered in the Commission on 13 May 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 27 November 2008.
4. Shri Vijay Singh, Sr. DFM & PIO and Shri Raj Singh Parihar, DPO,
represented the Respondents.
5. The Appellant, Shri Jitendra Kumar Sharma, was present through audio
conference.
Decision:
6. The Commission heard both the sides: the Appellant through audio
conference and noted that both, in response to the RTI-application as well as
the First Appeal, the Respondents had provided point-wise replies to the
Appellant. During the hearing, the Appellant continued to maintain and insist
that he had not received suitable replies the points 1-4 raised in his RTI-
application. The Commission fails to understand as to the grounds on which he
made this statement. In fact, even in ‘Grounds for the Prayer or Relief’ in his
Second Appeal, the Appellant has merely stated “information demanding by
Appellant are not provided by Appellate Authority and also not informed any
specific reasons for regretting” (Errors as per the original).
7. Under the circumstances, to put the Appellant’s mind at rest, the
Commission directs the Respondents to open up the personal file of the
Appellant to him for inspection, since all the issues raised by the Appellant are
likely to be contained in his personal file. This should be done by 23 December
2008. The Appellant will be authorized to get photocopies of the pages that he
requires after paying the fee prescribed in the RTI-Act.
8. The case is thus disposed of.
