The Appellant was not present in spite of notice.
On behalf of the Respondent, Shri K.G. Balasubramanium was
present.
2. In this case, the Appellant had, in his application dated August 25,
2008, requested the CPIO to inform him if the Bank had taken any action
against Sri NS Subramanian who had been arrested and was put behind bars
for 8 days in connection with a police case. The CPIO replied on September
26, 2008 providing only a part of the information. Not satisfied, the
Appellant moved the first Appellate Authority on October 8, 2008. That
authority disposed of the appeal in his order dated November 6, 2008 in
which he provided some further clarifications against some of the queries.
Still not satisfied, the Appellant has come before the CIC in second appeal.
3. We heard this case through videoconferencing. The Appellant was not
present in spite of notice. The Respondent was present in the Chennai
studio of the NIC. We heard his submissions. We carefully went through the
reply of the CPIO as well as the order of the Appellate Authority. In spite of
the fact that between them, a lot of clarification/information has been
provided, we think the following additional information must be given:
i) a copy of the relevant rules on the action to be taken against an official

who is arrested and kept behind the bars beyond a certain minimum period
of time;
ii) the photo copy of the relevant pages of the file in which the competent
authority had decided the course of action in the matter of the above
official after his arrest and detention came to the notice of the Bank;
iii) the photo copy of the relevant file dealing with the period of his
detention either as unauthorised absence from duty or leave.
4. We, thus, direct the CPIO to provide to the Appellant within 10
working days from the receipt of this order the above information without
fail. The case is, thus, disposed off.
5. Copies of this order be given free of cost to the parties.
