Background
1. The Applicant filed an RTI application dt.9.3.09 with the PIO, BSNL, Eluru
requesting for information against 4 points with regard to transfer cases under
medical grounds. On not receiving any reply, the Applicant filed an appeal
dt.3.6.09 with the Appellate Authority stating that District Administration had
supplied the same information in the year 2007 regarding the committee
formed/appointed by the GMTD for considering the request transfers on medical
grounds. On still not receiving any reply, the Applicant filed a complaint dt.7.7.09
before CIC. The CIC vide its order of even No. dt.29.9.09 directed the PIO to
provide information to the Complainant by 30.10.09 and directed him to respond
to a show cause notice issued to him by the Commission for the delay, by
5.11.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for November 12, 2009.
3. Both the Applicant and the Respondent were not present during the hearing.
Decision
4. The Commission received a rejoinder dt.15.10.09 in response to Commission’s
order dt.29.9.09 for not responding to the RTI application in which the CPIO
submitted that the application dt.9.3.09 was not recorded as an RTI case because
the same was received without any proof of RTI fee. The Applicant applied under
RTI on 1.7.09 with a proof of payment of Rs.10/- and the information was
provided on 21.7.09.
6. On perusal of the submission made by the Respondent, the Commission holds
that there is no delay on the part of the Public Authority in furnishing the
information and accordingly drops the penalty proceedings.
7. The case is closed at Commission’s end.
