Background:
Shri K.S. Raghubansi of Varanasi filed an RTI-application with the Public
Information Officer, Banaras Hindu University, on 27 December 2007, seeking
information relating to the service conduct regulations and code of professional
ethics for the teaching staff of BHU.
2. The PIO vide his letters dated 21 January, 28 January and 30 January
2008 replied to the RTI-application. Not satisfied with the reply of the PIO, the
Appellant approached the Central Information Commission with a complaint on
7 March 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 15 October 2008.
4. Shri Rajan Srivastava, Assistant Registrar & PIO, represented the
Respondents.
5. The Appellant, Shri K.S. Raghubanshi, was present in person.
Decision:
6. The Commission heard both the parties and noted that according to the
Appellant the information that he had received from the CPIO was misleading
on many counts. However, he had not gone into first appeal pointing out these
lapses. He is now directed to specifically point out the lacunae that he finds in
the reply of the PIO and accordingly file his first appeal. The Commission
directed the Appellant to do this before 21 November 2008.
7. The Commission ordered accordingly.
