Facts

:

1. Both the parties were heard on 19/3/2009.

2. The appellant has asked for information relating to the selection process
for LPG Dealership at different locations in the States of Orissa and Bihar. The
CPIO has replied and furnished partial information with which the appellant is not
satisfied. Hence, this appeal before the Commission.

3. In the course of hearing, it emerged that the CPIO has refused to furnish
the information relating to the empanelled candidates. The appellant pleaded for
providing complete information.

Decision:

4. The aspirants of LPG Dealership submit application together with
necessary documents to be eligible for the award of LPG Dealership. A large
part of information is submitted in fulfillment of the statutory requirements,
including personal and financial details. While it may be justifiable to withhold
such personal information as bank accounts, details of deposits, PAN number,
etc., there is no justification for withholding other details relating to eligibility of a
candidate. The CPIO is, therefore, directed to disclose the information asked for
after due application of 10(1) of the Act.

5. The appeal is, therefore, remanded back to the CPIO, who should review
its decision as per the above direction. The appellant would be free to approach
the Commission again, if he is not satisfied with the order of the CPIO.
