Facts

:

1. The appellant did not avail of the opportunity of personal hearing on
23/07/2008. The appeal is therefore examined on merit.

2. The appellant, a retired employee of the respondent, has asked for
information relating to non-settlement of his retirement benefits. In this context, he
had asked for certain information which have been partially furnished. Being not
satisfied with the CPIO’s and Appellate Authority’s responses, the appellant has filed
his 2nd appeal before the omission and pleaded for providing complete information,
which the CPIO has failed to do.

Decision:

3. It is unfortunate that even after lapse of several years of retirement, the
pension benefits have not been settled and paid to the appellant, who was
compelled to use the provisions of the Act to find out the reasons for the delay in
providing for his entitlement.

4. The Chairman of National Aviation Co. of India Ltd. is directed to look into the
matter and ensure that the appellant’s retirement benefits, as per his entitlement,
settled and paid at the earliest. He is also directed to strengthen grievance redressal

system to ensure that employees do not have to resort to the provisions of RTI Act
for such purposes as retirement benefits. A compliance report should be submitted
within 3 months from the date of issue of this decision.

5. The CPIO is directed to explain why penalty, u/s 20(1) of the Act should not
be imposed on him for providing incomplete information. He should submit his
explaination within 15 working days, failing which penalty would be imposed.

6. The appeal is thus disposed of.
