However, the learned counsel appearing on behalf of

respondent nos. 1 to 3 and the learned counsel appearing on

behalf of respondent no.7 are present. It has been stated on

behalf of the learned counsel for respondent no.7 that a

Second Appeal No. 388 of 2011 has also been filed by the

State of Bihar against the same judgment and decree, which

is stillto be placed for hearing under Order 41 Rule 11

C.P.C. The learned counsel is permitted to remove all the

defects in the said second appeal in the meantime.

Put up this appeal on 29th August, 2011, along

with Second Appeal No. 388 of 2011 as prayed for.
