The brief facts of the case have had under.
2. The Appellant had requested the CPIO in his letter dated 24 September 2007 for
obtaining a copy of the application form filed by late Narmada Bai for opening the
Savings Bank account No. 2570/35. It seems he did not receive a reply from the CPIO
within the stipulated period and therefore filed an appeal before the first Appellate
Authority on 20 November 2007. His appeal before the first Appellate Authority was
treated as an application for information and he was advised in the communication dated
19 December 2007 that he should first produce a copy of the death certificate of the late
Narmada Bai so that further action could be taken. The Appellant as come before the
Commission in second appeal against the above order.
3. During the hearing, the Appellant was not present in spite of notice. We heard the
submissions of the Respondent. We also studied the contents of the appeal. The
Respondent claims not to have received the original application at all. In view of the
claim, we do not think it right to consider imposing any penalty on the CPIO for not
providing the information within the stipulated period. However, now we direct the CPIO
to provide a copy of the application form filed by late Narmada Bai, the deceased wife of
the Appellant, within five working days from the receipt of this order.
4. With the above direction, the appeal is disposed off.
5. Copies of this order be given free of cost to the parties.
