Background
1. The Applicant filed an RTI application dt.19.2.09 with the CPIO, DoP, Chennai.
He stated that he had retired more than 4 years and 8 months ago and that
his retiral benefit applicable for the post in which he last worked is yet to be
settled. In this context, he requested for the following information:
i) Copies of proposals received from Division/Region in this regard
ii) Copies of proposal sent till date
iii) Nature of action taken after sending the proposals with copies of
reminders if any .
iv) Reasons for not filling up the posts on regular basis at Circle level,
even afters bringing the vacancy to the notice of Circle Office
v) Copy of note and order relating to his case.
The CPIO replied on 13.3.09 providing some information and stating that
information sought against point (iv) is not information as defined under
Section 2(f) of the RTI At. Not satisfied with the reply, the Applicant filed an
appeal dt.27.3.09 with the Appellate Authority. The Appellate Authority
replied on 16.4.09 stating that the information sought by the Appellant is not
in material form and, therefore, cannot be supplied. Aggrieved with the
reply, the Applicant filed a second appeal dt.30.4.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 7, 2009.
3. Mr. S. Kandasamy, Asstt. Postmaster General (Staff) cum CPIO represented
the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that information against points (i), (ii), (iii) and
(v) have been provided on 16.4.09 on payment of required amount of fee
about which details were furnished to the Appellant on 13.3.09. The
Commission directs the CPIO to provide any available information with
regard to point (iv) in the form of any communication, circulars or file
notings to the Appellant by 15 September, 2009 under intimation to the
Commission and accordingly disposes off the appeal.
