Facts
The matter is heard through video conferencing today dated 08.01.2010.
The appellant is present alongwith Advocate M. Ramaswami. The Public
Authority is represented by the officers named above. Advocate Ramaswami
would submit that the appellant had filed complaints with the Police Department
in September/November, 2008. He had sought information about the action
taken by the Police Department on these complaints in January, 2009. The
appellant received some information from the CPIO in February, 2009, but it was
not found to be satisfactory. Thereupon he had filed an appeal before the first
Appellate Authority. However, to his surprise, he was informed that FAA was
not in position. Resultantly, the first appeal remained undecided, compelling him
to file the present appeal before the Commission.
2. Ms. Pillai will submit that the first Appellate Authority was not in
position for some timedue to certain administrative reasons. However, the first
Appellate Authority has now been designated w.e.f. 17.3.2009.
DECISION
3. Be that as it may, the matter is remanded to Dr. V. Srikant,
SSP(L&O)(FAA) with the directions to decide the first appeal after affording an
opportunity of hearing to the appellant. If the appeal documents are not available
in his office, he may obtain a fresh copy thereof from the appellant.
4. The order of the Commission may be complied with in 04 weeks time.
