2. We heard these six cases together through video conferencing. The Appellant
was present in the Chennai studio of the NIC. In spite of notice, the Respondent was
not present. We heard the submissions of the Appellant.
3. In six separate applications, the Appellant had sought a variety of information
mainly arising out of the fact that the bank had wrongly included his name in the list of
defaulters as a coborrower in a NPA housing loan account. Although the CPIO had
attended to all his queries, more than 60 in number, the Appellant has alleged that the
information provided is not complete and adequate.
4. During the hearing, the Appellant submitted that the bank had dealt with him
rather shabbily by wrongly reporting to the CIBIL that both he and his father had been
coborrowers in the NPA housing loan account of one Suresh Kumar against whom
the bank had filed a suit. He further submitted that this act on the part of the bank
deprived him of his right to secure a loan and caused him both harassment and
embarrassment. It appears he has sought most of the information in order to ascertain
the facts behind the decision of the bank in sending certain reports to the CIBIL.
5. After carefully considering his submissions and the facts of the case including
the reply given by the CPIO in each of these cases, we are of the view that the
following additional information should also be provided to him:
i) the number and the date of the suit, if any, filed by the bank against the loan
account of Suresh Kumar including the name of the court;
ii) the name of the officers along with their designation who had corresponded
with the CIBIL in the matter of the inclusion of the name of the Appellant in the
loan account of Suresh Kumar;

iii) the photocopy of the circular/guidelines, if any, on the preparation of the list
of irregular HC02;
iv) the details of the postings of the three officers listed in the CPIO’s letter
dated 17 December 2009 from the date of the joining till the date of the RTI
application;
v) the details of the disciplinary proceedings, if any, instituted against these
three officers ever including the copy of the chargesheet served and the
punishment imposed by the disciplinary authority provided such proceedings
are complete and over;
vi) the photocopy of the contract signed by the bank with the courier company
which had booked the letter dated 19 November 2009 addressed to the
Appellant along with the photocopy of the proof of delivery and delivery run
sheet of the said letter;
vii) the photocopy of the letters sent by the Egmore Branch of the bank to the
head office in connection with the representations of the Appellant dated 13
March and 22 April 2009 respectively.
6. We direct the CPIO to provide the above information to the Appellant within 10
working days from the receipt of this order.
7. With the above direction, all the appeals stand disposed off.
8. Copies of this order be given free of cost to the parties.
