Background
1. The Applicant filed an RTI application dt.16.7.09 with the PIO, DoP, Sasaram
requesting for information against 3 points with regard to action taken on his
representation regarding late delivery of speed post article. On not receiving any
reply, he filed an appeal dt.20.8.09 with the Appellate Authority. On still not receiving
any reply, he filed a complaint dt.22.9.09 before CIC. The CIC vide its order
dt.30.10.09 directed the PIO to provide the information by 30.11.09 and to show
cause in writing for the delay in furnishing information, by 4.12.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for December 10, 2009.
3. Shri Vidya Sagar Shukla, Officiating O/S representing CPIO represented the Public
Authority.
4. The applicant was not present during the hearing.
Decision
5. The Supdt. of Post Offices, Sasaram vide his letter dt.26.11.09 submitted that reply
was provided on 20.7.09 while enclosing a copy of the reply along with his
explanation. In his reply he stated that no speed post article with the No. provided by
the Complainant has been sent from the Post Office and therefore there is no need for
enquiry and that the representation accordingly is not valid.
6. On reviewing the information, the Commission while holding that there was no delay
on the part of the Public Authority in providing information, also observed that the
Complainant has concealed the complete facts while filing his complaint before the
Commission.
7. The complaint is rejected.
