FACTS:
By his letter of 5.11.2008, the appellant had sought information on the
action taken by the Cantt Board, on his letter dated 13.12.2007, 20.12.2007,
28.12.2007, 7.3.2008 etc. The CPIO had informed him vide letter dated
25.11.2008 that the relevant file has been misplaced.
2. Dissatisfied with this, the appellant had filed the present appeal before
this Commission.
3. The matter was called for hearing on 20.10.2009. The CPIO did not
appear which is viewed adversely. It may be further noted that the CPIO has not
mentioned his name in the letter under reference. Nor has he mentioned that if the
appellant is dissatisfied with his decision, he may file first appeal before the first
Appellate Authority. The name and designation of the first Appellate Authority
has also not been mentioned. It, thus, appears to the Commission that the CPIO
(name not known) is taking his work in a causal manner and it may be deemed to
be a case of denial of information which is punishable u/s 20 (1) of the RTI Act.
INTERIM DECISION
5. However, before passing any order, the Commission would like to give
another opportunity of hearing to the CPIO. Hence, the matter is adjourned to
16-11-09 at 1110 hrs.
6. The CPIO, Cantt. Board, Meerut, is directed to appear before the
Commission with the relevant records. It is cautioned that if the CPIO does not
appear before the Commission on the above mentioned date the Commission will
be compelled to take ex-parte action against him.
