                         File No.CIC/SM/A/2009/000668
Right to Information Act-2005-Under Section (19)

                                                       Dated: 25 March 2010

Name of the Appellant : Shri Nitin Kumar Bhatnagar
                                       S/o Shri Ramesh Chandra Bhatnagar,
                                       Hartthala Gaon Sabzi Mandi Wali,
                                       Sonkapur, Muradabad.

Name of the Public Authority : CPIO, State Bank of India,
                                       Local Head Office,
                                       Moti Mahal Marg,
                                       Lucknow - 226 001.

The Appellant was represented by Shri Munish Kumar Bhatnagar
(Advocate).

On behalf of the Respondent, the following were present:-
        (i) Shri S. Mitra, Law Officer,
(ii) Shri R. K. Srivastava, AGM

2. In this case, the Appellant had, in his application dated nil, requested
the CPIO for a number of information regarding his entitlement for receiving
family pension. In his reply dated 3 October 2008, the CPIO provided him
with the desired information. However, the Appellant was not satisfied and
preferred an appeal. The Appellate Authority disposed of the appeal in his
order dated 28 November 2008 and directed the CPIO to provide some
additional information which, it appears, the CPIO forwarded to the
Appellant. Still not satisfied, the Appellant has come before the CIC in
second appeal.

3. We heard this case through videoconferencing. Although the advocate
of the Appellant was present in the Moradabad studio of the NIC, due to
some technical snag, it was not possible to complete the videoconferencing
with him. Instead, we heard him on telephone. The Respondent was present
in the Lucknow studio. The advocate of the Appellant admitted that the

CIC/SM/A/2009/000668
information sought had already been provided though he would like to have
a copy each of the PPO and the circular/guidelines on the payment of
pension to the disabled dependents of deceased employees. The Respondent
readily agreed to provide the same. We, therefore, direct the CPIO to send
these two documents to the Appellant within 10 working days from receipt
of this order.

4. The case is, thus, disposed off.

5. Copies of this order be given free of cost to the parties.
