FACTS

:

By his letter of 18.12.2008, the appellant had sought information on
08 paras in regard to certain communication made between the officers of
FCI regarding him. The CPIO had declined to disclose information on
paras 1, 2, 3, 4, 7 & 8 u/s 8 (1) (b) and 8 (1) (j) of the RTI Act. As regards
paras 5 & 6, the CPIO had informed the appellant that no such complaint
was traceable. On appeal, the Appellate Authority vide order dated
6.3.2009 had permitted release of information in regard to paras 1 to 4 and
upheld the decision of CPIO in regard to the remaining paras.

2. Heard on 14.9.2009. Appellant present. The public authority is
represented by the officer named above. The appellant submits a written
representation which is taken on record. Admittedly, information has been
released in regard to paras 1 to 4. As regards paras 5 & 6, Shri Choumal
would submit that no such complaints are available in his records.
However, the appellant submits copies of two complaints purported to have
been lodged against him. Photocopies of these complaints are handed over
to Shri Chomal with the direction to check up his records and if these
complaints are available in his record, then provide copies thereof to the
appellant.

3. As regards paras 7 & 8 of the RTI application, Shri Chomal would
submit that Smt. T.T. Lissy, an employee of FCI, had made a statement
which was recorded in Malyalam. A committee had written a brief note
thereon as referred to in para 8 of the application. He would forcefully
submit that this matter relates to the personal life and reputation of Smt.
T.T. Lissy and, therefore, is not disclosable to the appellant u/s 8 (1) (j) of
the RTI Act. We are inclined to agree with the submission of the Shri
Chomal.

DECISION

4. In view of the above, information in regard to paras 5 & 6 may be
provided to the appellant, if the requisite documents are available in the
records. If not, the appellant may be informed accordingly. The orders of
the CPIO & Appellate Authority are upheld in respect of the remaining
paras.
