Facts
:-
The appellant, vide his RTI application of 05/06/2009, addressed to CPIO, BSNL, Sri
Ganganagar, sought a copy of the preliminary inquiry report in the matter of disciplinary action
initiated against him.
2. Not receiving a reply even after 60 days, the appellant went in appeal to first Appellate
Authority Shri R.K. Goyal, BSNL, Lucknow.
3. When he did not receive a reply even after 90 days, the appellant has approached the
Central Information Commission for redressal of his grievance.
4. The CPIO instead of considering his request, sought additional information from the
appellant vide his letter of 03/08/2009 which was provided to him by the appellant on 05/08/2009.
5. Meanwhile, while the first appeal was pending before the first Appellate Authority, the
CPIO, vide his order of 17/07/2009, denied disclosure under sub section (h) of section 8(1).
6. The same was upheld by the first Appellate Authority vide his order of 07/09/2009.
7. Being aggrieved by this decision, the appellant has come before the Commission in second
appeal.
8. The matter came up for hearing today. The appellant was not present. The respondents
were present as above.
DECISION
9. Meanwhile, we have received a letter from the appellant informing that he is withdrawing
the second appeal before the Commission since the respondents had redressed his grievance.
10. The matter is accordingly closed at the Commission’s end.
