Shri P. Venkatachari vs Andhra Bank, Visakhapatnam on 23 June, 2009
                      Central Information Commission
           Complaint No.PB/C/2008/00667-SM dated 25.02.2008
Right to Information Act-2005-Under Section (18)

                                                       Dated: 23 June 2009

Name of the Complainant : Shri P. Venkatachari, C/o Shri P.V.
                                        Satyanarayana, CST Bylakuppe, Distt.
                                        Mysore, Karnataka.

Name of the Public Authority : CPIO, Andhra Bank, Regional Office,
                                        Seethamadhara, Visakhapatnam.

The Complainant was represented by Shri Srinivas Achari.

On behalf of the Respondent, Shri K.R.K. Raju, AGM, was present.

The case in brief is as under.

The Complainant had requested the CPIO on 25 February 2008 for the
printout and the CCTV footage containing the details of the withdrawal of
Rs.10,000 from his account through the SBI ATM on a certain date. The CPIO
wrote to him on 5 March 2008 and informed him that they had requested the
State Bank of India (SBI) for the CCTV footage as the money had been
withdrawn from their ATM and with regard to the transaction conducted in
the ATM of the Andhra Bank that day, the CPIO forwarded to him the
printout of the relevant transactions. It seems the SBI did not send him any
footage of their CCTV installed in the ATM kiosk. Instead of preferring any
appeal before the Appellate Authority, the Complainant has directly
approached the CIC with the present complaint.

2. The Complainant was represented by his son in the NIC studio at
Vishakhapatnam. The Respondent was also present there. We heard the
submissions of both the parties. The CPIO of the Andhra Bank to whom the
original request had been made, has already provided whatever record they

PB/C/2008/00667-SM
had in connection with the withdrawal from their ATM. The Respondent
submitted that the SBI did not respond with any CCTV footage covering the
operations in their ATM that day. After the passage of such a long time, it
will be fruitless to ask for a copy of that footage now. If the Complainant
suspected any foul play, he did not report the matter to the police either.
Thus, there is nothing more which can be given to the Complainant by way
of information now.

3. The complaint is, thus, disposed off.

4. Copies of this order be given free of cost to the parties.
