Facts
:
1. The appellant was heard on 26/2/2010.
2. In response to the RTI application, the first Appellate Authority has stated
as under:
“Information demanded by you is of the period of year 2000 to 2004 which
is more than five years old. As per the norms of record management the
supply order files are retained up to three years and as such records of
these periods are not available with the Directorate.”
3. In the course of hearing, the appellant stated that the information asked
for relate to the payment of huge amount to the parties, which have obtained
payments without delivery of articles/products, as mentioned in different
vouchers, which are identified. The appellant stated that the respondent has
given misleading and incorrect response. He therefore pleaded for providing a
copy of the document containing information about weeding out of the records in
question. He also pleaded for inspection of the documents so as to ascertain the
availability of information with the respondents.
Decision:
4. The appellant’s plea is accepted. The CPIO should provide proof of the
weeding out of the documents in question within 15 working days from the date
of issue of this decision.
5. The CPIO would also allow inspection of the relevant documents on a
date and time mutually convenient to both the parties so as to ascertain the

availability of information, which if available, should also to furnish as per the
provisions of the Act.
6. With these remarks, the appeal is disposed of.
