Facts

:

1. The complaints were scheduled for hearing on 24/2/2010. But, the
complainant did not avail of the opportunity of personal hearing. The complaints
are, therefore, examined on merit.

2. The complainant has asked for certain information, through separate
applications. He has stated that the CPIO has not furnished the information
asked for by him.

Decision:

3. It seems that the complainant has not submitted his first appeal before the
Appellate Authority of the respondent. If so, the complainant should have
submitted his first appeal, as required under the Act.

4. An information seeker is expected to ask for information, as per section
2(f) and (j) of the Act. The complainant is accordingly advised to re-submit his
RTI application to the concerned CPIO of the respondent, at the earliest, for
ready reference.

5. The CPIO is directed to furnish the information within 15 working days
from the date of receipt of fresh application, failing which, penalty proceedings
u/s 20(1) of the Act would be initiated. If any information is to be refused, the
grounds for doing so, should be clearly indicated for review, if necessary, by the
Commission.
