Background
1. The RTI application was filed on 12.05.08. The applicant requested for attested
copies of his original marks statement for papers A, B, C of the Postman
examination held on 6 February 08. The CPIO replied on 22.05.08 stating that no
such applications are entertained and forwarded for re-totaling and verification of
marks after 6 months from date of announcement. The First Appeal was filed on
02.06.08. The Appellant stated that the CPIO had misinterpreted his request and
that he only wanted his marks statement. The Appellate Authority replied on
02.07.08 directing the CPIO to supply the information sought within a week, free
of cost after removing from the statement, marks of other candidates. The
Appellant preferred a second appeal before the CIC on 28.07.08 not receiving any
reply from the CPIO.
2.. The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard the matter
on October 16, 2008.
3. The Appellant was present in person at the hearing.
4. Shri N.V. Prakash Rao, CPIO and Shri R.K.Jayebhaye, Appellate Authority
represented the Public Authority.
Decision.
5. The Commission noted that the CPIO had not taken prompt action on the order
passed by the Appellate Authority. However, a letter dated 13.10.08 from the
CPIO, addressed to the Commission, the CPIO stated that since the information
belonged to the year 2002, it could be traced with great difficulty as the file was
kept in the old records by his predecessor. He also informed in the letter that the
certified copy of the marks, as requested by the Appellant, have been provided to
him.
6. The Appellant expressed his satisfaction with the reply.
7.. The appeal is disposed off.
