FACTS
:
By his letter of 4.11.2008, the complainant had sought
information on the following 10 points :-
“(i) Copy of resolution No. CBR 14 Dated 14.9.1979;
(ii) Copy of resolution No. CBR 4 Dated 2.6.1981;
(iii) Copy of resolution No CBR 40 Dated 9.7.2008;
(iv) Copy of resolution No. CBR 41 Dated 25.11.2008;
(v) Copy of order dated 22.5.1981 by Director General Defence
Lands & Cantts, New Delhi;
(vi) Copy of building plan submitted by Anand Kumar & Vijay
Kumar Bernard for 52 blocks in Old Vijay Nagar Karondi
Cantt Ward No. 7 Ranjhi Jabalpur Dated 14.9.1979 and
2.6.1981;
(vii) Copy of information of completion of Colony was submitted
by the builder Anand Kumar & Vijay Kumar Bernard;
(viii) Copy of plan of Block No 4 Old Vijay Nagar Karondi Ward No
7 Ranjhi Jabalpur;
(ix) Copy of only application under section 73 (1) for transfer of
name dated 4.4.1995; &
(x) Copy of Building Completion and inspection by Staff of
Cantonment Board for Taxation purpose.
2. By letter dated 10.12.2008, the CPIO had asked the appellant to
deposit fee of Rs. 4/- for supply of requisite information. The
Appellate Authority had dismissed the appeal as infructuous vide
letter dated 3.1.2009.
3. Heard on 22.1.2010. Complainant present. Nobody has
appeared for the Cantt Board. The complainant fairly concedes that
some documents have been provided to him by the CPIO but
documents relating to paras (i) to (vii) have not been provided to him.
It is noticed that while the CPIO and AA has observed that the
documents have been supplied, according to the complainant,
documents relating to most of the paras have not been supplied to
him.
DECISION
4. Be that as it may, the CPIO is hereby directed to supply copies
of documents relating to paras (i) to (vii) of the RTI application to the
complainant, free of cost.
5. The order of the Commission may be complied with in 04
weeks time.
