Background
1. The Applicant filed an RTI application dt.7.6.08 with the CPIO, BSNL,
Motihari. He wanted to know about the number of sanctioned posts of
Telecom Mechanics along with their duties as also sanctioned posts in
Group D in BSNL, Motihari. He also requested for a transfer to a
clerical job although he was holding a job of a linesman . The CPIO,
BSNL, Motihari replied on 17.6.08 providing point wise information.
Not satisfied with the information, the Applicant filed an appeal
dt.24.6.08 with the Appellate Authority without asking for any relief.
The Appellate Authority replied on 28.11.08 stating that so far as reply
to para (5) of his RTI is concerned, which is related to the Applicant’s
representations for cancellation of transfer order, such matters can be
settled within BSNL using the internal forum of staff grievances and
RTI Act needl not be utilized for such issues. Aggrieved with this reply,
the Applicant filed a second appeal dt.18.2.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing for August 11, 2009.
3. Mr.Kailash Prasad Sinha, DE(Admin) representing CPIO and Mr.Ram
Yatna Yadava, SS(Est) represented the Public Authority.
4. The Applicant was heard through audio conferencing.
Decision
5. The Applicant, who was heard over the telephone, submitted that he is
not satisfied with the information provided against points 1 and 3. He
also stated that a number of Telecom Mechanics junior to him have
been posted in the clerical job and he wanted to know the reasons for
him not being posted .
6. The Commission accordingly directs the CPIO to provide complete
information against points 1 and 3 to the Appellant by 11.9.2009.
6. The appeal is accordingly disposed of.
