ORDER
Shri Ram Dulare Singh, the appellant has filed this appeal dated 9.11.2010 before
the Commission against Coal Mines Provident Fund Organization (CMPFO), Dhanbad for
not providing information to his RTI-request dated 15.3.2007. The matter came up for
hearing on 21.09.2011 through videoconferencing. The appellant was absent, whereas the
respondents were represented by Shri U. Panda, CPIO at NIC Videoconferencing Facility
Centre, Burdwan.
2. The appellant filed an RTI-application dated 15.3.2007 seeking “zerox copy of his
application form for obtaining CMPF account number No. DKR-127, which was given after
his date of appointment i.e. 29.11.1972 and zerox copy of the provision of Para 48 of
CMPF Scheme duly certified”. The CPIO vide letters No. CPF/MISC/RTI/BKR/27/R-
III/ASN/27 dated 5.4.2007 followed by letter No. 133 dated 26.4.2007 provided requisite
information to the appellant.
3. Aggrieved by the reply of CPIO, the appellant preferred first-appeal dated
9.7.2007before FAA. The FAA vide order No. CPF/Div:II/RTI/R-III/Asansol/1014 NAGPUR
dated 27.12.2007 provided to the appellant copy of relevant page of Allotment Register
which is a replica of the ‘H’ return.

4. During the hearing the respondent submitted that the instant appeal of the
appellant primarily points towards a dispute in his date of birth in his Form-B register
maintained by his employer i.e. the management of Chinakuri Mine-II under ECL. In the
instant appeal the appellant has expressed his doubt regarding manipulation in his date of
birth in ‘Form-B’ register, which is a document maintained by the employer and not by the
CMPFO. The CMPFO is not the custodian of his employment record. The appellant’s PF
money amounting to Rs. 738051/-, has already been refunded to him on 31.1.2011 on his
claim after exit from service. In addition, ‘Form-H’ does not contain any information
regarding date of birth of a subscriber. Moreover, the appellant’s identical complaint was
heard by the Commission in case No. CIC/AT/C/2007/01279 and the Commission vide its
order dated 18.2.2008 had observed that “since all information has now been disclosed to
the appellant, this matter need not be further progressed”.
5. After hearing the submissions of respondent and perusing the relevant documents
in file, the Commission is of the considered view that requisite information permissible
under the RTI Act, has been provided to the appellant by the respondent. For redressal of
his grievance relating to the dispute of his date of birth, the appellant is advised to
approach the competent authority i.e. Eastern Coalfields Ltd, his employer,
The matter is accordingly disposed of with the above observation.
