FACTS
:-
The matter, in short, is that the Appellant joined CPWD as a Beldar but as per his
claim, he has been working as LDC since 1985. Based on a certain Supreme Court
ruling, he has staked a clam for being given seniority in the rank of LDC with effect from
21/02/1987 instead of 21/05/1993. As he has not been given 1993 seniority, by his letter
of 20/08/2008, he has asked the reasons therefor.
2. Shri T.R. Prasad, Deputy Director(Admn.) vide his letter dated 18/09/2008 had
transferred RTI application to SE(Coord.). It appears that he was not provided any
response and, therefore, has filed the present complaint before this Commission.
3. The matter was heard on 26/06/2009. The complainant is present. The DDA is
represented by the officers named above. There appears to be some confusion as to who
is the relevant officer to respond to the queries raised by the complainant. After
discussion between themselves, both Shri Singh and Shri Prasad would submit that the
relevant officer in this matter is Shri S.C. Gangil, Superintending Engineer, M-35,
M.S.O. Building, 6th floor, PWD (Headquarters), IP Estate, New Delhi-110002, where
the complainant is presently employed.
DECISION
4. In view of the above, Shri S.C. Gangil, SE, PWD (Headquarters), is hereby
directed to send a suitable response to the complainant in next 06 weeks time. In case
the complainant does not receive the response, he will be at liberty to move the
Commission again.
5. Before parting with the matter, the Commission would like to observe that this
matter has been hanging fire between the senior officers of CPWD since last 10 months
which is not approved of. It is time now to settle it finally.
