Facts
The matter was heard on 3.6.2009. The appellant is before the
Commission. The public authority is represented by the officer named above.
During the hearing, it is noticed that this matter has already been decided vide
this Commission’s decision dated 28.4.2009 in File No.
CIC/WB/A/2008/000511/LS.
2. Advocate Agarwal would submit that pursuant to the decision of the
Commission in above cited case he had carried out inspection of the relevant
records and had noticed that the work in regard to construction of towers
commenced on 25.11.2008 and not in September, 2006, as claimed by the
CPIO in the last hearing. In support thereof, he produces copy of the
document which bears the date of commencement of work on 25.11.2005.
3. To this, Shri Singh would respond that he would have to check up with
his field office as to whether the tower construction works which commenced
on 25.11.2005 on the land belonging to Shri B.K. Agarwal, and requests for
03 weeks time to collect this information from his unit.
4. Advocate Agarwal would further submit that he would like to have
information relating to the commencement of work in respect of all towers
constructed in the land of appellant Shri Agarwal and that he would provide
tower number in 03 weeks time. Shri Singh has no objection to provide this
information.
DECISION
5. In view of the above, Advocate Agarwal is advised to provide the
towers numbers constructed in the land of appellant Shri Agarwal to Shri A.K.
Singh (CPIO) in 03 weeks time. On receipt of this information, Shri Singh
would intimate the date of construction of individuals towers in 03 weeks
time.
6. The matter stands closed at the Commission’s end.
