Background

1. The Applicant filed an RTI application dt.28.10.08 with the CPIO, DoP,
Bangalore. He requested for information on action taken against a postman
who had stopped paying pension to a poor widow and managed to steal the
money by fraud. On not receiving any reply, he filed an appeal dt.10.2.09
with the Appellate Authority. On not receiving any reply from the Appellate
Authority, he filed a complaint dt.18.5.09 before CIC. The CIC vide order
dt.25.6.09 directed the PIO to provide the information to the Complainant by
15.7.09 and also to showcause why a penalty of Rs. 250/- per day should not
be imposed on him for not furnishing the information within the statutory
period of one month. The PIO furnished a rejoinder vide letter dt.8.7.09.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for July 31, 2009.

3. Mr.A.M.D’Souza, CPIO & Sr. Supdt. of Post Offices represented the Public
Authority.

4. The Applicant was not present during the hearing.

Decision

5. The Respondent submitted that the information was given on 4.11.08
indicating that the preservation period of records pertaining to Money orders
is only 18 months and therefore no action could be taken against the postmen
in the absence of any evidence. Moreover as the money order was returned
to the remitter, the matter has to be taken by the remitter i.e. district
treasury for necessary action. He also submitted that on receipt of CIC’s
order the CPIO once again sent the letter dt.4.11.08 on 9.7.09.

6. Since the Complainant has not responded to the reply, it is assumed seems
that he is satisfied with the information and accordingly the complaint
disposed of.
