This matter came up for hearing on 02.03.2009. Both parties were
present.
2. This second-appeal is related to appellant’s RTI-application dated
08.03.2007, in which he had asked certain questions about the status of an
enquiry into alleged fraudulent and wrong transfer of a vehicle from Delhi to
Bihar. Reply was furnished to him by CPIO on 19.09.2008 after appellant’s
first-appeal was decided by the Appellate Authority on 05.08.2008.
3. During the hearing, respondents submitted that they were handing over to
the appellant a fresh set of response to his original RTI-queries.
4. Considering the facts of this case, apart from the information now
furnished to the appellant, it is further directed that appellant shall be allowed to
inspect the files and records related with his RTI-queries. CPIO shall indicate to
the appellant a date and time within two weeks of the receipt of this order for him
to inspect the files. Appellant shall be allowed to take such copies including
certified copies of the files and documents inspected by him, free of charge.
5. Appeal disposed of with these directions.
6. Before parting with this appeal, it is important to mention that the
vigilance enquiry in this matter seems to be going on interminably for over nine
years. It was mentioned during the hearing that the file in this matter was
untraceable and has now been traced by the present incumbent of the Vigilance
Wing of the Transport Department of the Government of NCT of Delhi, only
after the appellant filed the RTI-application. It is surprising and alarming that
files relating to investigation of offence under the Motor Vehicles Act are
allowed to pend for such long years and all those responsible for the wrongdoing
are allowed to go scot-free. It is not a reflection of a Department aware of its
responsibilities. It needs urgent correction. It also needs to be noted that but for

the appellant pursuing his RTI-application and the appeals thereof, this file
relating to the vigilance enquiry would never have seen the light of the day.
7. Copy of this decision be sent to the parties.
