Facts

:

1. The appeal was scheduled for hearing on 12/08/2009, but the appellant
did not avail of this opportunity. The appeal is therefore examined on merit.

2. On perusal of the documents submitted by the appellant, it is observed
that the CPIO and Appellate Authority have duly replied and informed the
appellant that the information is already in the public domain, which could be
obtained as per the prescribed rules of the respondent. The appellant however
has stated that the required information is not in public domain and therefore the
information have to be obtained from the concerned Company u/s 2 (f) of the Act
from the Company, which is the custodian of the information.

Decision:

3. The appellant is advised to clearly specify the required information which
requires that the desired information should be available in any material form.
The CPIO should accordingly examine the availability of information with the

respondent and furnish the same as per the available records, if relate to the
respondent. In case the required information is held by the Company in question,
the CPIO should obtaine from the concerned Company u/s 2 (f) of the Act and
accordingly, provide the information as per the provisions of the Act. The
appellant would also be free to inspect the documents so as to identify and
specify the required information, which should be furnished as per the provisions
of the Act.

4. With these observations the appeal is disposed of.
