Background

1. The Applicant filed an RTI application dt.22.10.08 with the CPIO, DAVP. He
wanted to know the action taken on his letter dt.19.9.08. On not receiving
any reply, he filed an appeal dt.6.12.08 with the Appellate Authority. The
CPIO replied on 30.12.08 stating that minor changes were incorporated in
Production rate card of DAVP on 1.6.06 and that he had distributed the new
rate card to all the producers after completion of process of empanelment of
producers in 2007. He added that DAVP is not responsible for the production
work given by the client Ministries directly to producers. Also, DAVP is
considering the process of revision of Production rate card. Not satisfied with
the reply, the Applicant filed another RTI application dt.5.1.09 requesting for
photocopy of file movement initiating the process of revision of Production
rate card. On not receiving any reply, he filed an appeal dt.2.3.09 with the
Appellate Authority. The Applicant filed a second appeal dt.2.4.09 before CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 7, 2009.

3. Ms. Mattu J.P. Singh, Director cum CPIO represented the Public Authority.

4. The Applicant’s representative Mr. Raj Kumar was present during the hearing.

Decision

5. The Appellant submitted that complete information with regard to the RTI
request dated 22.10.08 was provided to him. She added that information
was also provided on 2.4.09 along with four annexures. The Appellant then
demanded that since he has not received the said information the four
annexures be shown to him. The Respondent was unable to produce the
annexures since according to her they were in another file which has been left
in her office inadvertently and which has already been inspected by the
Appellant earlier. The Commission after hearing the submission from both
sides directs the CPIO to provide the annexures sent along with the covering
letter dated 2.4.09, to the Appellant by 14th August, 2009 to the Appellant.
The appeal is accordingly disposed off.
