This matter came up for hearing on 31.07.2008 pursuant to Commission’s
hearing notice dated 02.07.2008. Appellant was present in person, while the
respondents were represented by Shri Ashok Chakrabarty, Deputy Secretary
(Admn-II).
2. Appellant’s main contention is that he should be apprised of the resultant
seniority commencing with the year 1999 upto the year 2005 following each
DPC which was held between these two years. Appellate Authority seems to
have provided to him a final resultant seniority list but not resultant seniority
after each DPC.
3. Commission is at a loss to understand why such basic information should
be withheld from the appellant. It has been the Commission’s decision in
previous cases such as B.L. Sinha Vs. Company Affairs; Appeal No.
CIC/AT/A/2007/00256; Date of Decision: 03.05.2007 that DPC-related
information should be disclosed except information related to ACR grades, etc.
There is no reason why the seniority given to an employee after the conduct of a
DPC proceeding should be denied to him.
4. In view of the above, it is directed that the above information (paragraph 2
above) shall be furnished to the appellant by the CPIO within two weeks of the
receipt of this order. Appellant pointed out that the CPIO was unable to decide
who really holds the requested information. It is directed that the Appellate
Authority shall ensure that the information shall be provided to the appellant
taking it from the officer holding it, within two weeks of the receipt of this order.
If it becomes necessary, the Appellate Authority shall hold a meeting of the
officers likely to be holding this information and ensure that the information is
provided to the appellant within the stipulated time.
