Background

1. The Applicant filed his RTI application dt.1.11.08 with the CPIO, DoP, New
Delhi. He requested for copies of Annexure II to the Dte. Letter No.A-
34013/01/2008-DE dt.1.8.08 issued to all Postal Circles, detailing the marks
of all the candidates who appeared for the exam in DoP. The CPIO replied on
8.12.08 directing the Applicant to remit Rs.18900/- (Copy not in file) for the
information. The Applicant filed an appeal dt.9.1.09 with the Appellate
Authority. The Appellate Authority replied on 5.2.09 upholding the decision of
the CPIO. Aggrieved with the reply, the Applicant filed a second appeal
dt.15.4.09 before CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 6, 2009.

3. Mr. L. Mohan Rao, ADG(DE) cum CPIO and Mr. Lokesh Gupta, UDC
represented the Public Authority.

4. The Applicant was not present during the hearing.

Decision

5. The Respondent submitted that the RTI request dated 1.11.08 was received
by him on 11.11.08 and that the list of qualified candidates with marks has
already been supplied to the Appellant on 1.8.08. With regard to the list of
unqualified candidates, the Respondent stated that the list runs into
thousands. He also stated that as per the Dept’s rules of providing
information regarding marks of candidates only on payment of Rs. 5/- for
each marksheet, the Candidate was requested to deposit the amount of Rs.
18,900 for the information. The Commission, while noting that information
regarding qualified candidates has already been furnished to the Appellant,
denies disclosure of marksheets of unqualified candidates keeping their
sensitivities in mind and treating it as personal information under Section
8(1)(j),the disclosure of which would cause unwarranted invasion on the
privacy of the individuals.

6. The appeal is accordingly rejected.
