FACTS

By his letter of 05/05/2008 the Appellant had requested for information on 12
paras relating to Appeal File No. 2440/DEL/02 in respect of M/s Gopal Das Jagat Ram
Private Limited for A/Y 1994-95. Shri P.N. Parashar, Judicial Member, ITAT (CPIO)
had provided parawise information to the Appellant, vide letter dated 27/05/2008.
2. The Appellate Authority had disposed of the matter vide order dated 13/06/2008.
3. Aggrieved with the orders of the CPIO and the AA, the appellant has filed the
present Appeal.
4. Heard on 07/09/2009. Appellant present. None has appeared for the public
authority. The Appellant was heard. It is the submission of the Appellant that he is
essentially interested in information relating to para 03 of his RTI application. The same
is extracted below:-
“3. Please inform the total number of pages in the file and relevant
notesheets to Appeal File No.2440/DEL/02, M/s. Gopal Das Jagat Ram
Private Limited for A/Y 1994-95.”
5. The response of the CPIO is extracted below:-
“The relevant file may be inspected as per the provisions of ITAT
Rules, 1963.”

6. The appellant would submit that it is not convenient for him to inspect the file just
for ascertaining the number of pages it contains. He, therefore, forcefully pleadS that
this basic information i.e. number of pages in the file’ may be provided to him without
any further loss of time.
DECISION
7. The request of the Appellant is plain and simple. He simply wants to know the
number of pages in the relevant file. This information cannot be denied to him under the
provisions of RTI Act. Hence, the CPIO is requested to provide this information to the
Appellant in 02 weeks time.
8. The matter is disposed of accordingly.
