The brief facts of the case are as under.
2. The Appellant had, in his application dated 25 February 2008, requested the CPIO to
provide him with a copy of the minutes of a particular meeting about which a certain newspaper
had reported on 22 January 2008. The CPIO in his reply dated 7 April 2008 informed the
Appellant that no formal agenda points for the said meeting were drafted and no minutes could
be prepared and, therefore, since the information sought was not held by the Public Authority,
the same could not be provided to him. Against this reply he filed an appeal before the first
Appellate Authority on 15 April 2008. That Authority decided the appeal in his order dated 19
May 2008 and rejected it after endorsing the decision of the CPIO in the matter. The Appellant
has now come before the CIC in second appeal.
3. During the hearing, the Appellant was not present in spite of notice. We heard the
submissions of the Respondent and considered the contents of the appeal memo. The
Respondent filed written comments on the appeal. This case is quite clear. Since the authorities
concerned did not draw up any minutes of the said meeting, they cannot be expected to provide
a copy of it. We agree with the contention of the CPIO and the first Appellate Authority and
reject the appeal.
4. Copies of this order be given free of cost to the parties.
