FACTS

:

The matter, in short, is that the appellant is a resident of a
Jhuggi Colony situated at L-Block, Mangol Puri, New Delhi. By his
letter of 12.6.2007, he had requested for issue of Ration Card under
JRC category. As he was not issued the ration within prescribed of
45 days, he filed the RTI application dated 8.11.2008 in which he
sought information on 24 paras. The CPIO had responded to him
vide letter dated 29.7.2008 wherein he did not give any response to
the queries raised by the appellant and simply raised legal and
procedural issues. The Appellate Authority vide letter dated
1.10.2008 had taken the view that providing requisite information
would lead to disproptionate diversion of the resources of the
Department.

2. Hence, the present appeal.

3. Heard on 14.9.2009. Appellant present. The public authority
is represented by the officers named above. The main grievance of
the appellant is that he applied for Ration Card on 12.6.2007 but he
was issued Ration Card too late which has not been stamped, thereby
rendering him ineligible for supply of food articles. Due to delay
caused by the public authority a financial detriment has been caused
to him.

4. Shri Baxla would submit that delay has been caused due to
heavy work load and multiple commitments of the organization. He
would also submit that there is a policy for issue of BPL Cards for
persons of low income category to which the appellant belongs and
that he would process his case expeditiously, if he fulfills the requisite
requirements.

DECISION

5. Delay in the issue of Ration Card to a poor person like the
appellant is not appreciated. Be that as it may, Shri Joseph Baxla is
hereby directed to take expeditious action regarding the issue of BPL
Card to the appellant as per rules and procedures.
