FACTS
:
The matter, in short, is that the appellant is the owner/occupant
of plot of 8A/30G WEA, Karol Bagh, New Delhi. He had requested
DDA to issue him a lease deed but received no response from it.
Hence, he has filed the present appeal.
2. Heard on 11.2.2010. Appellant present along with his nephew
Shri Manish Kumar. The public authority is represented by the
officers named above. Shri Garg would submit that his case is under
active consideration and after the appellant completes all formalities,
it will be possible for him to issue lease deed in 03 months time.
3. On the other hand, Shri Manish Kumar would submit that he is
being harassed by Shri N.D. Goyal, an Assistant of DDA who
demanded and accepted a bribe of Rs 5000/- from him. He also plays
tape record of conversion with Shri Goyal in this regard. Besides, he
also alleges that Shri Arvind Bhushan, JE, had demanded bribe of Rs
10,000/- from him and he has tape recorded the conversation.
4. Shri Arvind Bhushan, however, denies the allegations.
DECISION
5. In view of the above, the following decision is recorded :-
(i) Shri R.P. Garg, Dy. Director (OSB), DDA, will intimate the
appellant all the formalities that are required to be completed
for issue of lease deed in 03 weeks time. On receipt of such
communication the appellant will take required action as
indicated by DDA. Thereupon, Shri Garg will expedite the
action for the execution of lease deed preferably in 90 days
time.
(ii) Floppy of the taped conversation submitted by Shri Manish
Kumar in a sealed condition may be sent to Shri Alok Swarup,
Director (Vig), DDA, for causing an inquiry into the matter and
for appropriate action. A copy of the inquiry report may be
sent to the Commission in 08 weeks time.
