Background:
Shri Satyawan of Jind, Haryana, filed an RTI-application with the Public
Information Officer, Northern Railway, on 10 December 2007, seeking
information regarding some service matters.
2. The PIO vide his letter dated 3 January 2008 replied to the RTI-
application. Not satisfied with the reply of the PIO, the Appellant filed an
appeal with the first Appellate Authority on 14 January 2008 and then
approached the Central Information Commission with a Second Appeal on 18
February 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 8 August 2008.
4. Shri Mohar Singh, Sr. DMM & PIO, Smt. Achla Sinha, CTM & Appellate
Authority, Shri Basant Lal, DPO (Legal), Shri M.K. Bansal, Ch. OS, Shri Surya Lal,
CWLI and Shri S.K. Saini, OS-II, represented the Respondents.
5. The Appellant, Satyawan, was present alongwith Shri Kadam Singh.
Decision:
6. The Commission heard both the sides and noted that according to the
Respondents, the application was vague. On going through the application, the
Commission tends to accept the submission of the Respondents. During the
hearing, the Appellant kept on insisting that what he wanted was orders to the
effect that he should be allowed to join his duties. At one stage, he also said
that he wanted to see the concerned files. He was told that while the first
request was not within the ambit of the RTI-Act, for the second, he should put
in a fresh RTI-application.
7. The case is thus disposed of.
