Appellant : Shri Saurabh Yadav

This matter came up for hearing on 17.02.2009 in response to
Commission’s notice dated 16.01.2009. Appellant was present through his rep.,
Shri Virendra Bahadur Srivastava while the respondents were absent, but have
filed their written-submission dated 29.01.2009 before the Commission.

2. I find that the CPIO, through his response dated 12.09.2008 to the
appellant’s RTI-application dated 28.08.2008, provided to him point-wise
information to all his queries. In his second-appeal, appellant has stated that the
information supplied to him was “misleading, incomplete and disgressing [sic]”.

3. Appellant has not stated how the information provided to him is
misleading or false. It is not possible to come to any adverse conclusions
regarding the information disclosed to the appellant in the absence of cogent
arguments about how that information was either false, or misleading.

4. On the basis of the evidence in this matter, it is not possible to allow this
appeal. Rejected.

5. Appeal disposed of with these directions.

6. Copy of this decision be sent to the parties.
