Background

1. The RTI application was filed on 5.6.08. The Appellant complained that two
registered letters sent by him through the Post Office were returned to him with
the comments that the addressee refused to take them. The Appellant wanted to
know why this happened; whether the decision to return the letters to the sender
was taken by the concerned Postman or the addressees really refused to take
them. The CPIO, in his reply of 21.6.08 stated that the envelopes of the two
registered letters contained the remarks of the Postman about the addressees
refusing to take the letters. The first appeal was filed by the Appellant on 27.6.08
reiterating his request for the information. The Appellate Authority replied on
8.8.08 upholding the decision of the CPIO. The Second appeal was filed on
4.9.08

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard the matter
on October 17, 2008.

3. The Appellant was present in person at the hearing.

4. Shri Bhola Shah, ASRM represented the Public Authority.

Decision.

5. Shri Bhola Shah, ASRM, Lucknow, SPO who represented the Public Authority
showed copies of the returned envelopes with the Postman’s comments. He said
it is possible that the addresses were not written correctly on the envelopes. The
Respondent also carried a letter from Chief Post Master, Lucknow GP, stating that
the comments on the envelopes were indeed written by the postman and that he
believes that the Postman is telling the truth. He showed the copied of the
envelopes with the postman’s comments.

6. The Commission accepts the reason given by Mr. Shah for non-delivery of letters
and advises the Appellant to approach an appropriate forum for redressal of his
grievance.

7. This appeal is disposed off.
