Facts
:
1. Both the parties were heard on 2nd July and 7th August 2009.
2. In the course of hearing, the details of information asked for and the
replies given by the CPIO and the Appellate Authority were discussed. The
parties have also submitted the respondent’s comments on the petition filed by
the appellant and the rejoinders submitted by both the parties were also
examined. While the appellant has alleged that the information furnished to him
is false and misleading, the CPIO has stated that the information, as available on
records, has been furnished.
Decision:
3. The CPIO has replied and furnished the information on the basis of the
feedback obtained from IDBI, the custodian of information in the instant case.
The CPIO has also indicated the action taken by the respondent on the complaint
submitted by the appellant. The information has been solicited in the form of
queries, the replies to which are unacceptable to the appellant, who has disputed
the content of the CPIO’s response, on the ground that the respondent has
provided incorrect information.
4. A CPIO is expected to provide the information, as per the available
records, relating to any action taken by the respondent. In case, the appellant
feels that the information furnished to him is incorrect or misleading, he is free to
inspect the relevant documents so as to identify and specify the information, as
per Section 2(f) of the Act, and accordingly, obtain the documents available with

the respondent. The CPIO should allow inspection on a date and time
convenient to both the parties.
5. Since the CPIO has not claimed exemption u/s 8 or 9 of the Act, this
appeal is considered unnecessary and is thus disposed of.
