Background
1. The Applicant filed an RTI application dt.6.7.09 with the CPIO, AIIMS requesting for
information against 4 points with regard to HPCA. On not receiving any reply, he filed
an appeal dt.21.8.09 with the Appellate Authority reiterating his request for the
information. On still not receiving any reply, he filed a complaint dt.30.9.09 before
CIC reiterating his request for the information. The CIC vide its order dt.29.10.09
directed the CPIO to provide the information by 30.11.09 and to show cause in writing
for the delay in providing information, by 4.12.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for December 8, 2009.
3. Shri A.K.Nim, Administrative Officer and Shri Surjeet Singh, UDC represented the
Public Authority.
4. The Complainant was not present during the hearing.
Decision
5. Shri Attar Singh, CPIO submitted an explanation in response to the show cause notice
vide letter dt.4.12.09. He stated that the RTI application was received on 14.7.09 and
that the Financial Adviser, AIIMS and Admn. Officer, Estt. Section-II, AIIMS were
requested to provide the requisite information vide letter dt.20.7.09. The information
was furnished by the two officers vide letters dt.20.8.09 and 7.8.09 respectively and
the reply in this matter was provided to the Complainant on 7.10.09. He added that
the Complainant vide letter dt.19.10.09 received on 21.10.09 has stated that
information against point 4 is not complete. The Financial Adviser, AIIMS was
requested to provide the requisite information vide letter dt.13.11.09 and Shri
S.K.Gupta, Accounts Officer provided the requisite information vide letter dt.24.11.09
which was received by him on 26.11.09 and forwarded to the Complainant on
4.12.09.
6. The Commission holds that complete information has been provided and since the
Complainant has not responded after receipt of the information, assumes that he is
satisfied with it and accordingly disposes off the complaint.
7. The Commission further noted that information was provided only on 7.10.09 and that
Shri Attar Singh, CPIO has not provided any explanation for the delay of almost 45
days. In view of the fact that he was not present at the hearing to submit his
explanation, the Commission gives him one more chance to show cause for the delay
in providing the information and why a penalty should not be imposed on him for the
delay. He is directed to submit his explanation in person on 2.3.09 at 2.30 pm.
