FACTS

By his letter of 20/06/2007, Shri Virendra Prabhakar had lodged a
complaint with the Commission to the effect that PIO, (RTI), Ministry of
Urban Development had not furnished the information requested for by him
by his letter of 14/05/2007.

2. The case was fixed up for hearing on 07/11/2008. Shri Virendra
Prabhakar did not appear before the Commission. The Public Authority was
represented by Shri R.N. Yadav, Deputy Director (Policy), Directorate of
Estates. Shri Yadav submitted that the information requested for by Shri
Prabhakar had been sent to him vide their letter dated 06/11/2008 and also
furnished a copy of the same to the Commission which was taken on record.
As to the cause of delay, Shri Yadav admitted that letter dated 14/05/2007
was received in their office but it has remained untraceable since then. He
also submitted that he has furnished the information to Shri Prabhakar on the
basis of copy of the aforesaid letter received from this Commission. Shri
Yadav also submitted that the officer in charge of the matter is Shri R.K.
Nigam, Assistant Director, who was suffering from illness at the relevant
point of time and, it appears, that the aforesaid letter of Shri Prabhakar
inadvertently got misplaced.

DECISION

3. As mentioned above, the requisite information has been furnished to
Shri Prabhakar. I have reason to believe that his letter dated 14/05/2008 got
misplaced inadvertently in the office of Public Authority which resulted in
delayed response. The directorate of Estates would be advised to streamline
their systems and procedures for timely response in RTI matters. With these
remarks, the matter is closed.
