The petitioner is an accused in the case registered for the offence under
section 25(1-b), 26 and 35 of the Arms Act.
Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case; the allegation of recovery of two cartridges is
wholly baseless; there is no allegation of any overt act against him; petitioner is
in custody since July,2010; petitioner is a local permanent resident; there is no
chance of his absconding.
Learned APP opposed the prayer for bail of the petitioner and submitted
that the petitioner has got one more criminal antecedent. However, he has not
disputed the other contentions of learned counsel for the petitioner.
Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Chief Judicial Magistrate, Jamshedpur in connection with
Mango M.G.M. P.S. case no.270 of 2010, corresponding to G.R. no.1695 of
2010.
